The Constitution of the United States Airborne Clan

Preamble:
This was created with the sole purpose of providing a defined set of rules for the clan's members. All members of the clan are to abide by this Constitution. It cannot be stressed enough that no clan member, no matter their rank, is immune to the provisions and regulations hereby declared in this Constitution. Therefore, punishment will be dealt to those who commit acts that are unconstitutional, punishments that will be more clearly defined later in this Constitution.

The Constitution:

Article I: (Permanence and Equality of Your Rights)
The Enlisted Ranks of the United States Airborne Clan, (which will hereafter be referred to as the USAB clan) the Officer Ranks, the Executive Board, and the Official Representatives of the USAB Clan (which will hereafter be known as the ORUCs) all have the same constitutional rights. However, it is their privileges that differentiate. Under no circumstances shall a constitutional right be suspended, denied, or abridged unless by constitutional amendment.

Article II: (Your Rights)
Every member of the USAB Clan, regardless of rank, has the same rights under its Constitution. Those rights are as follows:
1. Every member of the USAB Clan has the right to know why they were removed from the clan.
2. Every member of the USAB Clan has the right to appeal removal from the clan.
3. Every member of the USAB Clan has the right to keep their name and age among other personal information private .
4. In the USAB Clan, persons of all ethnicities, genders, religions, social backgrounds, subcultures, etc. shall be treated equally.
5. All members of society have the right to apply to join the USAB Clan unless they were previously removed from it.
6. Every member of the USAB Clan has the right to freely speak their mind about any topic as long as it is not done to purposely instigate a fight, is obscene, or is slander or libel.
7. Should the leaders of the clan choose not to follow the Constitution, the clan members have the right to start a new USAB Clan under this same Constitution.

Article III: (The Enlisted)
The Enlisted members are the regular members of the clan. Upon first having your application approved, your rank will automatically be set to Recruit. This is the lowest rank. Once you have fulfilled the appropriate requirements to be promoted to the next rank, your rank will be set to whatever it now should be. If it is not, send a message to the Officers, Executive Board, or ORUCs. If you are found to have fulfilled the requirements, your rank will be set to whatever it is now. This applies to all ranks within the Enlisted Ranks.
Please note that Enlisted members have the same constitutional rights as listed in Article II as all other members of the USAB Clan.

Article IV: (The Officers)
The USAB Administration (Which is comprised of the Officers, Executive Board, and ORUCs) shall be tasked with reviewing the applications of any persons wishing to join the USAB Clan and shall also be tasked with removing members who do not follow the rules or commit unconstitutional acts.
To be promoted to an Officer, an Enlisted member need write up a thorough and intelligent application as to why they should be promoted. This application does not have a template. The Executive Board and ORUCs, after reading the application, shall then vote upon whether or not to promote a clan member to an Officer.
The Officer Advisor shall be chosen by the Executive Board if a new Officer is added to the clan and if they so desire. It is his/her responsibility to relay information (additions, removals, complaints, suggestions, etc.) up to the Executive Board. The Officer Advisor also receives the final vote in the event of a tie within the Officer ranks.
To remove a member from the clan, a majority vote within the Administration is required. When this happens, a removal thread will be started and the Officers, Executive Board, and ORUCs will vote for or against the removal. This vote shall always take place in an IRC or Skype channel or in any other place specifically sanctioned for USAB Officers.
To add a member to the clan, a member of the USAB Administration must read and approve/deny the application. If the Officers fails to do so within one week of the application being submitted, the application will go to the Executive Board and the Officers will be reprimanded.
If a regular Officer or the Officer Advisor is found to be committing unconstitutional acts, they can be removed from their position and demoted to Veterans by a majority vote within the Executive Board and ORUCs.
It cannot be stressed enough that all Officers are to follow and enforce the Constitution.

Article V: (The Executive Board)
The Executive Board of the USAB Clan is charged with the task of making sure that the Officers are doing what they are supposed to be doing. They are also tasked with the most important functions of the clan, such as adding and removing officers, choosing the Officer Advisor, reprimanding clan members, organizing clan events, and making all important decisions for the clan. There must always be an odd number of Executive Board members to avoid a tie. Also, there must also be an Executive Board member from each game the USAB Clan is present in.
After a clan member has submitted an application to become an Officer, the Executive Board and ORUCs will review it and later vote on it. A majority vote between the Executive Board and ORUCs is required for an applicant to be promoted to Officer.
After a new Officer has been added, the Executive Board and ORUCs will take a vote on the next Officer Advisor. To win, a candidate must have the most votes of any other Officer. If there is a tie, then the decision goes to the ORUCs alone.
For an Officer or an Enlisted member to be promoted to the Executive Board, there must be a vacancy. This either means that the USAB Clan has expanded to have a presence in another game, or an Executive Board member was removed/formally resigned. Then, a formal application must be sent to the ORUCs. The ORUCs will then choose the next Executive Board member. At the clan's start, however, the ORUCs have appointed Executive Board members.
Executive Board members can be removed through an unanimous decision between the ORUCs and a majority vote within the regular Officers and Officer Advisor.
It cannot be stressed enough that all Executive Board members are required to follow and enforce the Constitution.

Article VI: (The Official Representatives of the United States Airborne Clan)
The ORUCs are the leaders of the United States Airborne clan. As previously stated, they have the same powers as the Executive Board members. However, they also have full control of the clan website, IRC channels, Skype channels, or anything else related to the USAB Clan.
Unfortunately, this can lead to power abuse. If an ORUC is committing acts that are unconstitutional and the Officers, Executive Board, and other ORUC do nothing about it, the members of the USAB Clan have the constitutional right to sever ties with them and create a new clan with the same Constitution and same name.
If an ORUC is inactive for an extended period of time, is removed from office by the unanimous vote of the Officers, Executive Board, and other ORUC, or issues a formal resignation, a member of the Executive Board will be chosen by a nomination by the remaining ORUC and a majority vote within the regular Officers and Officer Advisor to succeed him/her as the next leader of the USAB Clan.
Please note that to balance power, there must always be two ORUCs. Also, the ORUCs are required to follow and enforce the Constitution. Also, the ORUCs are, for all intents and purposes, part of the Executive Board.

Article VII: (Provisions for Amendment)
Should a change to the Constitution be required, an amendment must be added to the Constitution. In order for this to happen, the Amendment must be approved by a unanimous decision between the ORUCs, a 2/3 majority vote in the Executive Board, and a 3/4 majority vote in the Officers.
After an amendment is ratified, it must be publically announced and is effective immediately.

Article VIII: (Removal from the Clan)
If at any time, a clan member is found guilty of violating the Constitution or of breaking the rules, it is the constitutional obligation of the Officers to remove or reprimand the player.

Article IX: (Universal Laws)
The United States Airborne Clan has its rules for each of the games it is present in, but there are several rules you must always abide by:
1. Malicious racism is not tolerated.
2. Spamming is not tolerated.
3. Purposely instigating conflict is not tolerated.
4. Be respectful of other clan members and their opinions.
5. There will be no posting or advertising of obscene materials.
6. Follow clan rules and the Constitution at all times.
7. If the acts of a USAB member are in violation of this Constitution or any rules, requirements, or provisions of the USAB clan, they will be punished and reprimanded as the Officers of the USAB clan see fit.

Article X: (Ratification of the Constitution)
In order for the Constitution to be first ratified, the ORUCs must both agree to accept it as the official plan of government of the USAB Clan. After ratification, nothing in the Constitution may be changed except by constitutional amendment.

Amendments:

Amendment I: (Multi-Clanning)
All applicants to the USAB clan after December 10th, 2011 must sever ties with any other clan if they are accepted. Honorary memberships are exempt from this amendment provided that there is no formal allegiance to that clan and it is understood that it is a title and NOT a membership to said clan.

Amendment II: (Adaptation of "The Brendan Rule")
A new Recruit (someone who is not yet the "Active" rank) can be removed from the clan by an Executive Board member (which includes the ORUCs) for whatever reason they see fit. This removal can be overridden by a majority vote among the Executive Board.

Amendment III: (Sans Officiers {"Without Officers"} Clause)
If there are no Officers actively serving in the clan, Constitutional Amendments may be passed by a unanimous decision between the ORUCs and the Executive Board.

Amendment IV: (Interim Leadership)
If an Official Representative of the United States Airborne Clan announces that they will be unavailable for a week or more, they have the option of temporarily promoting an existing Executive Board member to the status of ORUC. This nomination must be approved by the other ORUC. If not, then another Executive Board member must be selected. If they are approved, the nominated Executive Board member will have all of the authority of the ORUC and may or may not be given temporary control of USAB sites, that is at the discretion of the ORUC who nominated them. They will remain as an ORUC until the nominating ORUC returns, at which point the Executive Board member will be demoted to their normal position. The nominating ORUC will keep the power of an Executive Board member during their absence.

If an Executive Board member announces that they will be unavailable for a week or more, they have the option to nominate an Officer to temporarily take their place. Note that this is not limited to the Officer Advisor. This nomination must be approved by an ORUC. If the nominee is not approved, another Officer may be selected. If the Officer is approved, they will have all the power and authority of the Executive Board member until their return, at which point the approved nominee will be demoted to their normal position.

Amendment V: (Revision of the Constitution)
The Constitution was revised in a way that was presented and approved by the Officers, Officer Advisor, Executive Board, and ORUCs. This revision took place on July 7, 2012 at 9:48 PM Eastern Standard Time.

Amendment VI: (Emergency Dictatorship)
In the event the clan is encountering major friction, the Executive Board may unanimously appoint one of the ORUCs to become full leader of the clan. While this dictatorship is in effect, all decisions regarding clan operations will be made by the dictator. During this period of time clan recruiting will be shut down, clan matches will cease, and there will be a mandatory meeting once a week for all Officers, Executive Board members, and the other ORUC. This period can only last 3 30-day months. If order is restored to the clan before the three months, the Officers, Executive Board members, and the other ORUC may vote out the dictatorship with a majority vote. If, after the 3 months, the clan is not restored to order the clan will split away. When this has happened, the Executive Board and ORUCs will be demoted to Officers and the Officer Advisor will become a new ORUC. This new ORUC will be able to choose any other member of the clan to refill the position of the Executive Board and the other ORUC.
